New York's highest court has ruled that judges in the Empire State must still retire at the end of the year in which they turn 70, rejecting a legal challenge to the state's 157-year-old constitutional requirement.
In a decision released Thursday, the New York Court of Appeals determined that a voter-approved 2024 constitutional amendment prohibiting age discrimination does not invalidate the existing judicial retirement age provision already written into the state constitution.
Three State Supreme Court justices had challenged the rule, arguing that the new constitutional protections against age discrimination should eliminate the mandatory retirement age. While judges can apply for certification to continue serving beyond age 70 under certain circumstances, the plaintiffs sought to overturn the age cap entirely.
The court disagreed, writing:
π βThe retirement age is part of New Yorkβs constitutional design. The stateβs voters, Legislature, members of the bench, and judicial candidates have understood that judicial service is limited in this specific way.β
The ruling marks another setback for efforts to eliminate the age limit. In 2013, New York voters rejected a proposal that would have increased the mandatory retirement age for judges from 70 to 80.
Supporters of the current system argue it ensures regular turnover and opportunities for new judges, while critics contend experienced jurists should not be forced to leave the bench based solely on age.

As tick season ramps up across New York, a new federal initiative aimed at fighting Lyme disease is drawing attention from patients, advocates, doctors, and researchers alike.
Health and Human Services Secretary Robert F. Kennedy Jr. recently unveiled a plan that includes:
